1. Acceptance of Terms

By accessing, browsing, or using the BIRTHEORY website located at birtheory.app (the "Website"), and any associated applications, products, reports, AI-powered consultations, or other services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, our Disclaimer, and our Data Protection (PDPA) Policy.

If you do not agree to all of these Terms, you must not use the Services. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

2. About BIRTHEORY

BIRTHEORY is a Human Potential Intelligence platform powered by BirthCode & LifeCode — a proprietary convergence of life pattern sciences that reveals your unique life architecture. BIRTHEORY is operated by BIRTHEORY (the "Company", "we", "our", or "us"), registered in Bangkok, Thailand.

Important: BIRTHEORY is not a fortune-telling, divination, or astrological service. Our analysis is a self-awareness tool grounded in proprietary methodology. It does not predict the future, diagnose medical conditions, provide financial advice, or replace professional counsel of any kind.

3. Eligibility

• You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account and purchase Services.
• By using the Services, you represent that you have the legal capacity to enter into a binding agreement.
• If you are using the Services on behalf of a minor (e.g., for the Pure Child Edition), you represent that you are the parent or legal guardian and consent to the processing of the minor's data.
• If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Account Registration & Security

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Immediately notify us of any unauthorized access to your account.
• Accept full responsibility for all activities conducted under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.

5. Description of Services

BIRTHEORY offers the following Services:

• Free Tool: A complimentary BirthCode & LifeCode generation based on your birth data.
• Personalized Reports (Volumes): Paid reports including the SIGNATURE Edition, Pure Child Edition, Family Compatibility, 12-Month Life Mission, Love & Life Compatibility, Love & Relationship, Career + Wealth, Life Mission & Timing, Business Compatibility, and HR Compatibility.
• AI Consultant ("Birthy"): An AI-powered consultation service that answers your personal questions through the lens of your BirthCode & LifeCode.
• Question Credits: Purchased or subscription-based credits used to ask questions to the AI Consultant.

The content, features, and availability of Services may change without prior notice.

6. Payments, Pricing & Refund Policy

6.1 Pricing

All prices are displayed in US Dollars (USD) unless otherwise stated. Prices are subject to change without notice. The price applicable to your purchase is the price displayed at the time of checkout.

6.2 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card details on our servers. By making a purchase, you agree to Stripe's Terms of Service.

6.3 Refund Policy

Due to the digital and personalized nature of our products:

• Reports: All report purchases are final and non-refundable once generation has begun, as each report is uniquely created for you using AI analysis.
• Question Credits (Single/Pack): Unused question credits are non-refundable.
• Subscriptions: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for the remaining period.
• Exceptions: If a technical failure on our side prevents delivery of a purchased report, you may contact us at [email protected] within 7 days for a replacement or refund at our discretion.

6.4 Free Credits

Report purchases may include complimentary question credits. These credits are granted as a bonus, have no cash value, are non-transferable, and may expire per our then-current policies.

7. Subscriptions

• Subscription plans auto-renew at the end of each billing cycle (monthly or annually) until cancelled.
• You may cancel at any time through your account dashboard or by contacting support.
• Question credits from subscriptions are allocated per billing cycle and do not roll over to subsequent cycles unless explicitly stated.
• We reserve the right to modify subscription pricing with 30 days' advance notice. Existing subscribers will be notified before changes take effect.

8. Intellectual Property

8.1 Our Property

All content, technology, methodology, trademarks, trade names, logos, designs, and other intellectual property associated with BIRTHEORY — including but not limited to the BirthCode system, LifeCode system, the 7 Dimensions framework, archetype names, report templates, AI models, and website design — are the exclusive property of BIRTHEORY and are protected by intellectual property laws worldwide.

8.2 Your License

When you purchase a report or use our Services, you receive a limited, non-exclusive, non-transferable, personal license to access and use the content for your own personal, non-commercial purposes. You may not:

• Reproduce, distribute, sell, license, or publicly display any BIRTHEORY reports or content.
• Reverse-engineer, decompile, or attempt to extract our proprietary methodology, algorithms, or systems.
• Use our content to create competing products or services.
• Remove or alter any copyright, trademark, or attribution notices.
• Use automated tools (bots, scrapers, crawlers) to extract data from the Website.

8.3 User Content

By submitting information (birth data, questions, goals, etc.) to BIRTHEORY, you grant us a non-exclusive, royalty-free license to use, process, and store that data solely for the purpose of providing and improving the Services. You retain ownership of your personal data subject to our Privacy Policy.

9. Prohibited Uses

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Impersonate another person or provide false information.
• Share your account credentials with others or allow others to access your account.
• Attempt to gain unauthorized access to our systems, servers, or databases.
• Use the Services to harass, abuse, or harm any person.
• Submit personal data of third parties without their explicit consent (PDPA-compliant consent is required for family members, partners, and employees).
• Use generated reports for employment discrimination, insurance decisions, credit decisions, or any decisions that adversely affect individuals based on their analysis results.
• Circumvent or interfere with any security features of the Website.
• Resell, sublicense, or commercially exploit any part of the Services without written permission.

10. AI-Generated Content Disclaimer

BIRTHEORY reports and AI Consultant responses are generated using artificial intelligence and our proprietary methodology. By using these Services, you acknowledge and agree that:

• AI-generated content is provided for self-awareness, personal development, and informational purposes only.
• Content should not be treated as professional advice (medical, financial, legal, psychological, or otherwise).
• AI responses may contain inaccuracies or generalized statements. BIRTHEORY is not liable for any decisions or actions taken based on AI-generated content.
• You should always consult qualified professionals for matters requiring expert advice.
• Results may vary between users and between sessions. Reports and AI responses are not guaranteed to be identical even with the same input data.

11. Third-Party Data & Consent (PDPA Compliance)

Certain Volumes (Family Compatibility, Love & Life Compatibility, Business Compatibility, HR Compatibility) require you to submit personal data of third parties. By using these features, you represent and warrant that:

• You have obtained informed, explicit consent from each third party whose data you submit.
• Each third party understands what data will be collected, how it will be processed, and for what purpose.
• You will indemnify and hold BIRTHEORY harmless against any claims, damages, or liabilities arising from your failure to obtain proper consent.

BIRTHEORY will display a consent acknowledgment before collecting third-party data but relies on you to ensure proper consent has been obtained.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• BIRTHEORY, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
• Our total liability for any claim relating to the Services shall not exceed the amount you paid to BIRTHEORY in the 12 months preceding the claim.
• We do not warrant that the Services will be uninterrupted, error-free, secure, or available at all times.
• We are not liable for any damages resulting from unauthorized access to or alteration of your account or data.

13. Disclaimers & Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Indemnification

You agree to indemnify, defend, and hold harmless BIRTHEORY, its officers, directors, employees, agents, and affiliates from and against any claims, losses, damages, liabilities, costs, and expenses (including attorney's fees) arising out of or related to:

• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property and privacy rights.
• Your submission of third-party personal data without proper consent.
• Any content or information you submit through the Services.

15. Termination

• We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice.
• Upon termination, your right to use the Services ceases immediately. Previously purchased reports may remain accessible for a reasonable period at our discretion.
• Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

16. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict-of-law principles.

Any dispute arising from these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, either party may submit the dispute to the Thai Arbitration Institute, with arbitration conducted in Bangkok, Thailand, in the English language.

For users in the European Union, nothing in this clause limits your right to bring proceedings in the courts of your member state of residence in accordance with applicable EU consumer protection laws.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We may notify you via email or through a prominent notice on the Website.
• Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
